Andrea Kelly Smethurst is an attorney investigator who has conducted hundreds of workplace investigations for public and private employers. She has also investigated student Title IX and other complaints in schools and colleges. Andrea speaks Spanish fluently and regularly conducts investigations in which she interviews witnesses in Spanish.
Andrea also provides expert witness testimony on the adequacy of workplace investigations, training, policies and other employment-related matters.

Andrea has served as an Equal Employment Opportunity Monitor and Decree Monitor for employers required to implement a monitoring program. As a Monitor, Andrea has overseen employer compliance with harassment and discrimination training requirements, developed complaint procedure policies and procedures, and overseen employer response to and investigation of employee complaints.
Prior to founding this firm in 2001, Andrea was an employment associate with Sheppard, Mullin, Richter & Hampton and with Dillingham & Murphy. At these firms, she counseled employers on employment practices and policies. In addition, she represented employers in federal and state court and in administrative matters before the DFEH, the EEOC and the Labor Commissioner.

Andrea is an honors graduate of the University of Pennsylvania, and received her law degree from the University of California at Berkeley, Berkeley School of Law.
Andrea is a member of the Association of Workplace Investigators (AWI) and is on the faculty of the AWI Training Institute. She is an AWI Investigators Certificate Holder (AWI-CH). Additionally, she holds the atIXa Title IX Investigator's Certification.
Andrea is a member of the California State Bar's Employment Law Section, a member of and past President of the Contra Costa County Bar Association's Employment Law Section, and a member of the Society for Human Resource Management. Andrea is on the board of the Northern California Employment Roundtable and has previously served as its President and Vice President.

Workplace and School Investigations:
Conduct prompt, thorough, and neutral investigations in response to employee and student complaints of harassment, discrimination, retaliation, bullying and other alleged misconduct. Investigations can be conducted in Spanish or English.
Equal Employment Opportunity Monitor:
Serve as an EEO Monitor and Decree Monitor for employers who are required to implement a monitoring program. We audit harassment and discrimination policies, procedures, and training programs as well as oversee investigations and complaint handling.
Expert Witness Testimony:

Serve as an expert witness for both plaintiffs and defendants about best practices in preventing and responding to employee complaints as well as the adequacy of investigations conducted.
